Peoples Democratic Party, PDP Candidate, Senator Ademola Adeleke, on Tuesday, 9th May, 2023, floored his All Progressives Congress, APC opponent, Adegboyega Oyetola, at the Supreme Court, to retain the Osun State Governorship Seat.

The Court, in its judgment read by Justice Emmanuel Agim, also upheld the Appeal Court’s judgment which upheld the election of Adeleke as the state governor.

The apex court held that the appellant failed to adduce enough evidence to prove his allegation of over voting in the July 16, 2022 governorship poll.
In January 2023, the election tribunal had sacked Adeleke and PDP while it declared Oyetola winner of the election.

Justice Tertsea Kume, who served as chairman of the tribunal, said the election was marred by over-voting.

However, Adeleke appealed the decision of the tribunal before the Appeal Court, which on Friday, 25th Match, 2023, overturned the decision of the tribunal and affirmed the incumbent governor as winner of the 16th July, 2022 governorship polls.

The three-member panel of the court, led by Mohammed Shuaibu, unanimously overturned the earlier decision of the election petition tribunal, which nullified Adeleke’s victory in January.

Ejecting the verdict, a confident Oyetola headed for the apex court but had his hopes dashed as the court of final arbiter ruled in favour of Adeleke.
